These Terms and Conditions ("Terms and Conditions") govern the terms and conditions of the Rate Your Stay and Win Another Competition ("Competition") and are the only binding document governing the Competition. The Contest is organized as a promotional contest and is not a game of chance within the meaning of Act No. 171/2005 Coll. on Gambling and on Amendments and Additions to Certain Acts, as amended.

Article I.

Competition Organiser

The organizer of the Competition is the company Mores Resort, a. s., registered office: Galvaniho 17/C, 821 04 Bratislava, ID No.: 46 830 995, Company registered in the Commercial Register of the District Court Bratislava I, Section Sa, Insert No.: 6213/B (hereinafter referred to as the "Organizer").
Article II.

Duration of the Competition
The Competition will run from 1.1.2022 to 15.12.2022 inclusive (the "Competition Period").
The Contest will end with the drawing of the winners of the Contest on 23.12.2022 (hereinafter referred to as the "Drawing Day").

Article III.
Persons Eligible to Participate in the Contest
The Competition is open to any natural person who has received a newsletter after completing their stay at Hotel Lomnica with a valid link to the evaluation questionnaire (hereinafter referred to as the "Newsletter"), (hereinafter referred to as the "Participant"), after fulfilling all the conditions for participation in the Competition as set out in these Terms and Conditions.

Any person who enters the Competition in breach of the rules of these Regulations, good manners or applicable law will be excluded from the Competition. The Organiser will also exclude from the Competition any Entrant who continues to object to his/her participation in the Competition or to the processing of his/her personal data for the purposes of the Competition and requests the Organiser to do so.

Article IV.
Conditions of Participation in the Competition and Competition Rules
The condition for participation in the Competition is to fill in and send the evaluation questionnaire, which is part of the newsletter and is sent to the guests of Hotel Lomnica after the end of their stay.
The Organiser shall not reimburse the Participant for any costs incurred by the Participant in connection with his/her participation in the Contest or winning the Contest.

Article V.

Drawing, contacting winners and handing over prizes
The winner of the Contest (hereinafter referred to as "Winner") will be drawn by a person authorized by the Contest Organizer by random drawing from the Participants, with the basis for the drawing being exclusively the completed evaluation questionnaires, which are part of the newsletter sent to the guests of Hotel Lomnica after the end of the stay. Only those questionnaires containing a valid e-mail address will be included in the competition.
A total of 1 (one) draw will take place.
The person authorized by the Organizer will draw 1 (one) Winner on the Drawing Day, who will receive the prize specified in Article VI, paragraph 1 of these Statutes.
Information on the results of the draw will be published within 3 (three) working days after the draw on the website https://www.facebook.com/hotellomnica. The Organiser will publish the Winner of the Competition under his/her first name. Subsequently, the Organiser will contact the Winner by e-mail in order to obtain the information necessary for the delivery of the prize.
The Winner will then be informed by the person authorised by the Organiser of the further procedure for claiming the prize.
In order to hand over the prize, the Winner of the Contest is obliged to provide the Organizer with the necessary cooperation.
The Winner will forfeit his/her claim to the prize if the Organiser is unable to contact the Winner on the basis of the information provided by the Winner;
the Winner will reject the prize;
the Winner forfeits the prize;
the Winner is not entitled to the prize in accordance with these Regulations for any other reason.
In the event that the Winner loses his/her claim to the prize pursuant to Article V. paragraph 7 of these Regulations, the Organiser will hold the draw once again. In the event that the new Winner also loses his/her claim to the prize, the Organiser shall be entitled to determine the further disposition of the prize.
The prize will be sent to the Winner electronically to the e-mail address he/she has notified to the Organiser after being contacted pursuant to Article V. paragraph 5 of these Regulations.
The Organiser will send the prize to the Winner within 30 (thirty) days at the latest.
The Organizer of the Contest shall not be liable for non-delivery of the prize to the Winner if it was caused by reasons on the Winner's side.
The Organizer has the right not to return the prize to the Winner or to demand its return if it finds that the Winner of the Contest has failed to comply with the terms and conditions of the Contest according to these Regulations or has violated any of the provisions of these Regulations.

Article VI.

Winning the Competition
The prizes in the Competition are as follows: A voucherfor a stay in a standard room at Hotel Lomnica for one night for two people.
No monetary or non-monetary compensation or other consideration may be given to the Winner in lieu of the prize set out in Article VI.1 of these Terms and Conditions. The prize is not transferable to another person.
The prize from the Contest is subject to personal income tax under Act No. 595/2003 Coll. on Income Tax, as amended (hereinafter referred to as the "IncomeTax Act"). The prize, the value of which does not exceed EUR 350,- (in words: three hundred and fifty euros), is exempt from income tax in accordance with the Income Tax Act. The Competition Organiser shall inform the Winner of the value of the prize, which shall be stated in the acceptance protocol by which the prize is handed over. The Organiser shall not be liable for the Winner's failure to comply with his/her tax obligations.
The Organiser reserves the right to make additional changes to the prize of comparable quality and value.

Article VII.

Privacy Policy
The Organiser hereby informs the Participants that for the purpose of the eventual handover of the prize, the Organiser will process their personal data to the extent and in the manner specified on the Personal Data Protection website on the basis of the consent to the processing of personal data granted by the Participants or Winners to the Organiser when filling in the contact form sent to them by the Organiser.
The Organiser of the Competition hereby declares that the processing of the Participants' personal data will be carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC and certain relevant provisions of Act No. 18/2018 Coll. on the protection of personal data and on the amendment and supplementation of certain acts.

Article VIII.

Final provisions

These Statutes shall enter into force on the date of their publication by the Organiser and shall come into force on the date of their publication on the website www.facebook.com/hotellomnica.
The provisions of these Statutes may be unilaterally amended by the Organiser by unilateral declaration, with each individual amendment or supplement being effective from the moment of publication in the manner specified in Article VIII, paragraph 1 of these Statutes.
In the event of any conflict between the provisions of these Regulations and any advertising, promotional or other material of a similar nature and purpose or other announcement made by the Organiser in all such cases relating to the Competition, the provisions of these Regulations shall prevail at all times.
Each Entrant, by entering the Competition, expresses his/her unconditional and unconditional agreement to the provisions of these Terms and Conditions.
There is no legal right to be entered into the Competition or to win a prize. The prize from this Competition is not subject to any legal action or any other financial or non-financial consideration or compensation, pursuant to Section 845 of Act No. 40/1964 Coll., Civil Code, as amended.
The Contest Organizer reserves the right to cancel, suspend, postpone or terminate this Contest without drawing and announcing the Winner.
The Competition Organiser is not responsible for any technical problems in the transmission of data by electronic means.
